There's no such thing as a circumstance where only one response is possible. I'm not saying this is the only one, I'm saying this is no worse than other, equally fair ones.

Taking away someone's phone is illegal, too, you know. If you don't pay your bills, collectors can repo your stuff and break them if they so choose, because it becomes theirs. Generally it's not done, because they can get something else out of it, but it's not really any different.

Breaking whatever they own is not somehow worse than giving it away, not for the kid anyway.
