You can sexually assault someone without actually having sex?

(Anonymous) 2013-02-02 01:19 am (UTC)(link)
So if Bob pretends to be his brother Joe (that's is the closet real-life comparison) and kisses Joe's wife, that's sexual assault?

If Joe's wife doesn't know it's Joe, then yes I'd argue that yes it certainly is.

You don't remember the Glee uproar over one person kissing someone else without their permission and people were screaming assault? Kissing counts. I mean I'd call it the jaywalking of the assault family but it gets the X-mas newsletter.

(Anonymous) 2013-02-02 01:34 am (UTC)(link)
um....
yes?

Is this a trick question?

(Anonymous) 2013-02-02 02:37 am (UTC)(link)
Sexual abuse, technically, but yes.

(Anonymous) 2013-02-02 01:29 am (UTC)(link)
Oh.

So you're one of those people.

are you serious?

"Those people" being people who don't think sexual assault is ok? Or those people who understand the legal definition of sexual assault? Either way, yes.

(Anonymous) 2013-02-02 02:01 am (UTC)(link)
DA

The thing is that the legal definition sort of depends on where you live. I only ever heard of "rape by deception" in an American context. It might exist in other places, but I went 30 years without ever even hearing about it. And while I'd find it skeevy or weird, I'd never have considered it "rape" coming from my own background - because you still consent to the sex.

I mean, if your boyfriend would lie to you about their background, but you still had sex willingly - would that also be seen as some sort of assault? Or is it specific to people who impersonate someone else?

I still find the concept very weird.

(Anonymous) 2013-02-02 02:16 am (UTC)(link)
Well I think if you trick someone into having sex, then it's rape.

I don't think kissing someone does, though. Unless you're holding her down.

(Anonymous) 2013-02-02 02:28 am (UTC)(link)
Yeah, but that's sort of tricky, isn't it?

I mean, say that I tell you that I have millions, and you have sex with me because you're looking for a rich partner, would that be rape?

If I told you I was a famous actress in my country, and you slept with me because you get off on famous people - would that be rape?

I find the definition really difficult on that one.

(Anonymous) 2013-02-02 02:40 am (UTC)(link)
You're using fuzzier examples, but we have clear ones:

If Person A is pretending to be someone Person B would agree to sleep with (their husband, girlfriend, etc), it is rape. Person B was consenting for their SO to have sex with them, not Person A.

(Anonymous) 2013-02-02 05:01 am (UTC)(link)
Lying about specific details regarding your life is not the same as pretending to be another person entirely.

[personal profile] iggy 2013-02-02 05:02 am (UTC)(link)
Not rape, but certainly assault or abuse. You probably couldn't build a legal case on it, but that doesn't make it any less wrong.

(Anonymous) 2013-02-02 05:00 am (UTC)(link)
Legal definition or not, if someone thinks they've consented to having sex with John, but they're having sex with Ben and Ben doesn't let them know who they are (let's say they're imaginary twins), how is that not rape?

When you consent to sex, you don't consent to sex with anyone, you consent to sex with that specific person. I don't understand how this could be legal anywhere.

I mean, if your boyfriend would lie to you about their background, but you still had sex willingly - would that also be seen as some sort of assault?

No? Because you're still consenting to sex with that specific person, even if you don't know everything about them.

So if I walk up to you and grab your crotch, that's perfectly fine?

(Anonymous) 2013-02-02 01:47 am (UTC)(link)
Did Peter grab MJ's vagina?
cadremage: (Default)

[personal profile] cadremage 2013-02-02 01:48 am (UTC)(link)
That's not the point. The point is that sexual assault can occur without there being actual sex.

(Anonymous) 2013-02-02 09:46 am (UTC)(link)
No, I would scream at you and file a report to the police. For the statistics, I doubt they would do anything but if they did it would be a nice +
