Is this illegal? I'm not sure if it should be or not, but if it's based off of an actual show with just name and setting changes, and it's kind of openly known it's based off of it, wouldn't it be illegal to profit from it?

Nah, if it was there wouldn't be 50 Shades or the Cassie Clare books or a ton of people doing this. You can't copyright a basic idea so yeah, once the names and some other details are changed, it becomes "loosely based on" something.

If you ever visit New York, poke around the purse stalls for knockoff Louise Vuitton purses; the logo is altered just enough to legally be considered an homage. This is the same thing.
