(Anonymous) 2013-03-19 04:32 am (UTC)(link)It depends on whether the copyright owner pursues their copyright. And in certain cases, if the copyright owner doesn't pursue their copyright in one situation, they can effectively lose their rights to it in others.
There was an interesting discussion about the particulars of this in Homestuck fandom a while back, with a lot of details I didn't know about before.
