Re: Fanfiction Vs. Fanart; the monetary debate

I believe fanart is more likely to fall under fair use, but I'm not a lawyer and should not be quoted on that. However, yes, both are technically illegal at their core. For example, Disney frequently and successfully sues artists who use their imagery in their work.
