Talking/not talking depends on the situation - I know neither you nor him, have no idea as to his character and the laws of the country you live in, but it sounds like your friend might be right. In any case, even though hypothetically an out-of-court agreement is a possibility, you and your friend have more data for making the eventual decision than any of us do.
