In the fairy tale world, she ripped out the Huntsman's heart (giving her control over his life/death), and then had the guards drag him away to her bed chamber.

In the real world (where she controlled everyone's false memories/personalities), she made it so that he was her lover (rape by deception), and killed him when he started falling in love with someone else.

If he had retained his memories, and Charming was willingly and knowingly having sex with Abigail without her having her memories, I'd agree with you.

But that's not what's happening here.

Regina fucked with both Charming and Abigail's memories, though, so neither of them were really them self, or were able to consent properly.

No, he isn't. Neither he nor Abigail actually had sex until he woke up from his coma, the rest was just *~memories~* made by Regina and then they consented to sex with each other. The sex they had was consensual. You can say he cheated on Abigail with Snow because they all thought David/Charming and Abigal were married, but not that he's a rapist.

The argument of "he wasn't really married" doesn't have anything to do with it because marriage doesn't equal consent. You can be married and still be raped by your spouse.
