One is peeping, by sight, with no injury to myself but embarrassment if I found out. The other is sight AND forcible touch and physical violation. They are nowhere near equal.

I'd say the "injury" would be more than embarrassment. I would certainly feel violated, angry, etc.

But no, it is not as bad as physical rape.

It's kinda rapey, as it has some similar characteristics, but it is not rape. It's lower on the "sexual asshattery" scale.

DA, but no, I would not. I'd consider it a shitty voyeuristic and intrusive thing to do, and possibly subject to criminal prosecution under some law or other (I hope,) but if the perpetrator never actually laid a hand on me, it would not be rape or assault.

Not every creepy intrusive act is rape. Conversely, just because such an act is not rape doesn't mean it's okay or not creepy and intrusive.
