Trying too hard TOS

(Anonymous) 2014-03-02 10:14 pm (UTC)(link)
Was reading through the new Tumblr TOS, and I'm all for making things plain English, but this is just trying to hard to be hip and cool:

Gore, Mutilation, Bestiality, or Necrophilia. Don't post gore just to be shocking. Don’t showcase the mutilation or torture of human beings, animals, or their remains. Dick.

We're not in the business of hosting adult-oriented videos (and it’s fucking expensive).

Username/URL Abuse or Squatting. Tumblr's usernames/URLs are meant for the use and enjoyment of all of our users. Don't squat, hoard, amass, accumulate, accrue, stockpile, rack up, buy, trade, sell, launder, invest in, ingest, get drunk on, cyber with, grope, or jealously guard Tumblr usernames/URLs.

Is it just me? Is expecting a modicum of professionalism too much for even the "grown ups" behind Tumblr and its rules?

I think it's just you. Seems fine to me.

No, I agree. I get the impulse behind being hip, etc., but I guess I'm just a stodgy old woman, because it ends up annoying me a lot of the time. I feel much the same way about a lot of these things, though, and I think I might be the odd one out. In general, there's a time and a place for being cool and informal, but the workplace isn't it. I guess I just feel like there's a reason some kinds of jokes and comments are considered inappropriate, and even if in another setting with the same people you'd feel comfortable saying them, it doesn't mean that they're okay in all settings. Like at work.

Gotta pander to the userbase.

probably a way to get people to actually read it since most won't give a shit. i saw people talking about it, how funny it was, whatever. so when i got the pop up i bothered to read it for once lol.

I don't agree, but on the other hand (while I don't want Tumblr to get sued), I think it'll be UTTERLY HILARIOUS if they are, and it goes to court, and some poor lawyer from their legal department has to stand up in court and refer to those TOS, all the while moaning about how they told tumblr not to write it that way.

I appreciate that it's something I actually read without zoning out or clicking out of after the first sentence. Fits with the site as well.

This. At least it's entertaining.

Re: Trying too hard TOS

(Anonymous) 2014-03-03 12:53 am (UTC)(link)
This. I think it's the first time I've actually read a TOS instead of just scrolling down until I could click the little "I accept these terms and conditions" box.

I'm not sure what's wrong with this, other than possibly the "it's fucking expensive" but that doesn't bother me too much personally.

Don't post gore just to be shocking

What if I want to post gore to be genial.

It's just you. Lighten up, jeez.

Apparently it's not just me as at least one person above you agrees with me. And fuck, I was just pointing out a minor annoyance not proclaiming the end of civilization. Maube YOU need to lighten up.

Did you put this much effort into rebutting the other people on this thread who thought you were being too touchy about it?

Re: Trying too hard TOS

(Anonymous) 2014-03-03 02:58 am (UTC)(link)
No, because they didn't demand I "lighten up." Sorry if you feel attacked but I don't appreciate that in the slightest. It's dismissive and belittling and doesn't feel very good now, does it?

*rolls eyes*

I don't feel attacked, i feel like you're overreacting in a *huge* way. I'd tell you 'lighten up' again but i fear apoplexy.

Oh no, "lighten up!" The Worst Possible Thing! Calm your tits.

No, I think you're the one who needs to lighten up. They were just telling you to lighten up, geez.

The part of my brain that takes things seriously and reads things carefully and critically (i.e. the part of my brain that takes over when I read a legal document, like a ToS) actually turns off when I see profanity. I've nothing against coarse language, but it will make me take things less seriously.

The fastest way to make me not care about following the rules of your website is to intersperse those rules with nonsense and profanity, and I'm willing to bet there's more than one contract lawyer out there who agrees with me.
I'm just waiting for some legal action to happen where someone's hoarding tumblr URLs, and it comes down to "we can't tell what that section of the ToS is trying to say, so we conclude that it is irrelevant".

(Anonymous) 2014-03-03 03:30 am (UTC)(link)
What percentage of the tumblr userbase is contract lawyers?

Clearly, not enough.
I don't think they keep any on staff, either.

See, if that were like an FAQ or guideline type thing, I wouldn't care. But the Terms of Service are a legal contract, so the idea that someone would try to make it 'hip' is irritating and honestly kind of concerning.

None of that is in the actual ToS, though? This is all from the Community Guidelines, and no, I don't personally have a problem with the Community Guidelines trying to be cute and funny so people will actually read them.

The ToS itself is 90% professional, 10% tl;dr for the average person. Which I also appreciated and I wish more ToSes were like that.

The new guidelines were all anybody was reblogging (and talking about, and reading) for at least a day. Tumblr definitely knows its audience.
