Yes. I have had friends threatened with legal action by kids' parents over the contents of their websites. I've seen websites taken down because someone's mommy didn't like what her kid was reading or looking at, and threatened to out the owner to her employer.

No adult with any sense wants to get embroiled in that kind of legal fight, which is why we do our best to avoid it. Even if they won in court, their life would still be ruined. They would still be tarnished as a predator. Just because you don't think that's right or fair doesn't mean it wouldn't happen.

You don't get to decide what other people ought to be willing to risk, or what their boundaries ought to be. If you really can't understand why people aren't willing to take those risks, then you aren't mature enough to be hanging out in the porny parts of the Internet.

I'm not telling anyone they need to run legal risks. I am saying that the conversation in fandom often makes it sound like there's a legal precedent for losing such a case, despite the fact that I don't know of any. (And I was asking because there's plenty that I don't know.) I'm sorry you've seen fandom spaces shut down by irate parents who threatened to call in lawyers. That sounds miserable. It's just that the few fights I've seen have gone down at this level, with someone folding because legal action was threatened. I suppose I'd have to ask a fan who is also a lawyer in the US to get a better sense for whether this is pure intimidation or something that people could be successfully sued for.

Did you not read what the AYRT was saying? Even if such a case were won, simply getting embroiled in something like that can seriously harm a person's reputation or life. Most people are going to value not being labeled a creeper or a pedophile, even if only by popular opinion, over the ability of some random teenager to get their jollies on the internet.

I read everything they said, and I'm not criticizing anyone's choices with regards to that. Legal action is one hell of a threat.

Most of fandom, at least the part of it that I frequent, is made up of adult women. While I'd assume we have a few predators, we don't remotely fit most people's idea of what a sex offender is like. I think the likelihood that most of our offline communities would turn on us because someone accused us of writing porn on the internet that was found by a minor is low. (Though, granted, this might depend on where you live.) I think the likelihood of fandom turning on someone for having lawyers sicced on them, in that situation, is even lower. But it's perfectly sane and reasonable not to risk that.

Wasn't it due to some kind of parental complaint that ff.net removed nc-17 to begin with? that's a consequence where younger people affected adults right there, even if it didn't end up in legal territory.

Never mind if there's a child-custody issue. Some of those can get really ugly, with people pulling out all kinds of nasty tactics. Saying "She writes pornography and publishes it on sites that she knows for a fact are read by underage kids" is a nice card to be able to play, you know what I mean?
