Dude, if you're a 30-40 something year old man who has sex with someone under the age of consent, you ARE a sex offender. It's not mislabeling, and it's certainly not the minor's fault.

Well lets face it, if a girl shows up naked and says she wants to have sex with a man, it's a little bit her fault if sex happens.

If she's 17, then whether it's her fault or not depends on which U.S. state they're standing in.

Age of consent is weird.

On Saturday, you have sex with someone who has aggressively pursued you. This person is completely innocent and had absolutely nothing at all to do with you having sex with them, and the fact that you did have sex with them means that you're a sex offender, because they happened to be 17 at the time.

However, if on Sunday, you had sex with that same person under the exact same circumstances, then both of you would be responsible for what happened, and you would not be a sex offender, because they would have turned 18 by then.

There is a reason that we've criminalized having sex with minors. But there absolutely is some arbitrariness involved at the upper end of it, and to say that a minor never bears any responsibility is ridiculous.
