Does anyone know about sex with peers under the current age of consent laws? Would both parties be guilty of statutory rape, or is the law really only to protect the kids from getting taken advantage of by the adults?

(Anonymous) 2014-03-22 02:26 am (UTC)(link)
It depends on whether or not the given state or country has a close-in-age exemption. Many places do, but not all.

Depends on the state if you're talking US.

(Anonymous) 2014-03-22 02:37 am (UTC)(link)
A lot of them have close age exceptions - within 2 or 3 years. But some of them, California, for instance, yes, if two sixteen-year-olds have sex, they can both be prosecuted (as a misdemeanor).

Thanks to both anons above. I thought that was the case, but I wasn't sure if any states had particularly ridiculous laws on the books, or if they did they would even enforce them. I thought everyone can pretty much agree that teens having sex with their peers isn't a horrible notion, and that we were just all in a kerfuffle over adults having sex with them. I just wanted to make sure I wasn't running afoul of any actual facts.

I have never heard of two underage people (who are the same age) getting in trouble for having sex with one another. And I think in a lot of laws (including my own state's, though I'm not sure) there's staggering - like 18/20 is ok, so is 16/18 but not 16/20.

(Anonymous) 2014-03-22 04:05 am (UTC)(link)
In that case, I think we can safely say that the age of consent laws are largely there not to keep teenagers from having sex (an impossibility, I'm sure), but to keep adults from taking advantage of inexperienced and vulnerable people who still aren't considered full adults in their own right. I'm just curious why this sentiment is so contested around here.

(Anonymous) 2014-03-22 05:22 am (UTC)(link)
I'm the anon who made the comment about not dropping the age of consent and perhaps raising it due to brain development a few comments higher up in this.

Yes. This. I really wonder. As I have zero issues with a fifteen and sixteen year old having sex with each other. Or a sixteen and eighteen year old. I do, however, have an issue with a sixteen year old having sex with a grown adult (like a 22 year old or older). (And honestly? I think it is kinda skeevy for an 18 year old to have sex with someone older than 22. As a lot of young adults really mature from 18-21. It's not saying that everyone who is older having sex with an 18 year old is creepy, as there are some 18 year olds who are really mature for their ages (often, sadly, because they were forced to grow up quickly due to life circumstances). However, the potential for a maturity discrepancy is very much there. (It's actually why I find relationships such as Edward/Bella and Buffy/Angel problematic. I cannot understand why someone with that much life experience would have anything in common with a teen.)

Sorry for the TL;DR. Short version? I totally agree

TV Tropes has an article on this. Go Google Mayfly/December romance.

(Anonymous) 2014-03-23 04:37 pm (UTC)(link)
I think it's one of those things that seems skeevy until you're in the situation, to be honest. I always was grossed out in college by my friends who dated guys in their 20s. Then I fell for a 27-year-old the week before my 20th birthday. More than a decade later, we're happily married with two kids, and I'm a lot less prone to judging age differences in other adult relationships.

(I don't think I was super-mature, or he was super-immature, or anything like that. We just ... made sense together. Sometimes that happens.)

That age gap matters a lot less in your 20s than before, I gotta say.

yes? that is why they are there. I'm not sure where you're coming from - do you think I don't agree with that?

(Anonymous) 2014-03-23 01:32 am (UTC)(link)
DA
Not you, but apparently a lot of other people in the thread given the amount of defense I've seen of adult sex with 13 year olds here. But I'm an American, so apparently my thoughts on the matter are overly moralistic and judging.

ugh, yeah, fuck that. My opinions are what they are because I care about children, not because I'm from the US (which still has a shit track record in general of protecting people from abuse, IMO).

An adult having sex with a 13yo is not ok however you slice it. Call me moralistic and judging all you want, anons. BRING it.

You sound 13.

(Anonymous) 2014-03-23 03:49 pm (UTC)(link)
An european 13 is the equivalent of an american 25 in terms of maturity.

Wow, really? Something magical in the air of Europe that alters the normal rate of cognitive (by which I mean neurological and physiological) maturity of human beings?

Or was that just supposed to be another "my country/continent is better than yours!" barb? Because I'm not playing that game, nonny. I thought all of us were better than that, tbh.

(Anonymous) 2014-03-23 07:45 pm (UTC)(link)
It's simply a better society and culture than yours.

(Anonymous) 2014-03-23 07:57 pm (UTC)(link)
Watch now the american make a complete clown of herself when she denies the massive role society and culture have in the development of cognitive abilities

So that makes 13-year-olds as cognitively mature as adults? Automatically? How does that work? Come on, show me some scientific evidence.

evidris is that you?
