To be fair to Batman, if the Joker got executed for a murder that someone else committed then it means the real killer got away with it, and that is not a good thing at all. Even if Batman waited until after the execution to reveal that "oops, executed the wrong guy oh well it was only the Joker" it still increases the chances of the right murderer getting off because their slimy defence attorney (and is there any other kind in Gotham?) could parlay that into reasonable doubt on the old "well we laready executed one wrong guy, do you the jury want to take the chance of making it two?". Which has happened in the real world, juries don't like convicting on cases where one person has already been wrongly convicted on even if the evidence is impressive against the new guy. One of the problems with the DP is that you have to execute the right person each and every time to keep faith in the system.
