Whether or not you'd be justified, people do that kind of thing all the time anyway. People tend to hire who they like the most, not who's the most qualified, and so long as they aren't too extreme about it (couple of least-offensive tokens here and there to throw off the scent), nobody pays it any mind.

I don't disagree that it happens all the time, but I wouldn't say that nobody pays it any mind. Certainly the person being discriminated against, at least, would take issue if they were aware it was happening. If presented with the hypothetical, most people wouldn't be so willing to say that discriminatory hiring practices are just hunky dory.

In any case, the examples go on and on. Should I have the right to petition for a change of seats on an airplane if I feel uncomfortable having to spend 12 hours sitting next to someone? Should my HR rep be "okay" with my request to transfer because I can't be in the same department as a certain person?
