I thought it was the other way around? That they intended it to be messed-up-consensual but fucked up the writing and filming so it appeared as rape? If so it makes sense that the narrative wouldn't treat it as rape, in S4 at least. Still, it was, and I hope they manage some retcon that makes sense for S5.

I think it honestly didn't occur to them that if she said no and he did it anyway it was rape. Which is all kinds of scary, frankly. The narrative didn't treat it as rape because the writers didn't see it as rape. But yes, it was rape.
