Well he is still not quite over the Timewar/burning all civilization (he thinks), she is still a clear and present danger to others, the Doctor is not quite as opposed to capital punishment as either he or his fans like to think he is, would any other planet agree to imprison her (his foes have a tendency towards cardboard prison-syndrome), it is one thing to say he is going to do it but he isn't standing on Raxacoricofallapatorius yet so there is plenty of time to change his mind before the final curtain falls, and finally and most damning of all; all other eventualities tend to be a bit complex and require a lot of negotiating and work and the Doctor has a distinct tendency in all his incarnations (yes, even Seven) to avoid those and go for more straightforward approaches which he can easily (in theory) walk away from.
