I read a fanfiction once [of the Harry/Draco variety, not terrible but kind run of the mill ... /off topic] that basically explained that houses such as Malfoy Manor and the like had a bunch of enchantments in it so that A) it couldn't be traceable* and if there were underage magic happening, the ministry wouldn't know it, so Draco could practice whatever magic to his little shriveled hearts content [that line was actually in the story I read haha]. So there's that theory too.

*I may be mixing up my fanfiction with that plot point...

Yes, I think underage magic without supervision was the problem, not underage magic in itself. The Weasleys all had broomsticks and the twins tried to make Ron swear an Unbreakable Vow before school age.
