Except telepaths usually can't help overhearing thoughts, and have to do special training to repress them.

just because they can't help it doesn't mean we aren't right to fear and shun them. Maybe that guy who freezes people could do us a favor and end the terror by killing the rapist.

Imagine you have a person with an uncontrollable tic that makes them slap people unless they strap your arm down. If that person wanders around knowing they could accidentally scratch someone's eyes out and actually does injure someone, then that person is heading for jail because they knew they had the potential for injury and did nothing. Same applies to telepaths, if they wander around thoughtsdropping and do nothing to actively train themselves not to (note in the Marvel-verse, yes they can train themselves to tune out) then they are showing the same callous disregard.

And that is just with passive telepathy. If they are doing Emma-comics-Frost's fave trick of screwing with a person's mind and leaving all sorts of nasty little booby traps on certain words and rewriting personality, then they ought to be facing old sparky.

No. But if a guy with tourettes smacks a little girl around then yeah he should go to jail if there was a way to control the urge to slap.

But they are not hurting anyone by just reading thoughts. If they used what they read to hurt people (blackmail, cheat, whatever) then yes that is bad.

okay that's not actually true. My brother has Tourette's and one of his tics is making an involuntary motion with his arms stuck straight out. He ended up getting his fingers tangled up in someone's hair in a store and hurting them. He didn't get in trouble for it. It was an accident.

Or just if they wanted this person who knows they have a problem to take steps to deal with it and not have other people suffer instead. Tourettes sucks, it is a condition that cause the person that has it problems, that sucks too. However, if they know they have the potential to injure someone, and especially if they already have injured someone, then they are an asshole if they don't take measures to help counter that. That sucks too, but sometimes life is just one big bag of hairy goat balls all needing to be sucked, and ya gotta suck 'em all. The asshole is not the random person that got hurt by someone not controlling their condition, the asshole is the asshole that is not doing anything to prevent their condition hurting someone else. A disability is not now, nor ever has been nor will be, a get out of jail free card for avoiding personal responsibility.
