I don't see the problem. Just like you don't rip the iron from someone's blood without permission (or rather you shouldn't unless you are a bad guy), you don't invade someone else's mind without permission. Mystique should be free to look as blue as she wants anywhere she wants (although, yes, I would recommend some extra clothing), and Emma and Charles are free to use their telepathy on anyone who has given permission to do so. I'd see no problem using it to send their "spoken" thoughts in a public place too, as long as it is just sending and not reading.
