Well now, Mystique could be. She has potential. I mean if she impersonates someone and has sex without disclosing she is not the person she is impersonating, then that is rape. It is obtaining sex by deception, which fits the rape statute in a lot of places (in Israel, for example, if you are Palestinian and do not disclose that, and someone even thinks you might be Jewish and has sex with you, then you can be arrested for rape; even if it was otherwise entirely consensual).

Evn though the media treated the case as 'poor Palestine, evil Israel,' the Palestinian actually did rape her.

Holy crap, it is worse than it seems. Not only was there a massive cover up by the Israeli prosecutor, it turns out that the woman accuses rape as a hobby and couldn't even properly remember what she was supposed to be testifying about, according to the article you linked. The accused was railroaded into a plea deal to avoid the hobby-accusations coming out in court.

No. The mutant who can freeze you isn't a murderer if he's not freezing anybody.

A telepath goes around raping nearly everybody in their sphere of influence, then has the gall to be insulted when somebody wears a helmet to keep them from doing that.

A telepath who didn't rape wouldn't be a rapist, this is true. But half of them rape without even trying and the ones in that picture do it intentionally.

Except telepaths usually can't help overhearing thoughts, and have to do special training to repress them.

just because they can't help it doesn't mean we aren't right to fear and shun them. Maybe that guy who freezes people could do us a favor and end the terror by killing the rapist.

Imagine you have a person with an uncontrollable tic that makes them slap people unless they strap your arm down. If that person wanders around knowing they could accidentally scratch someone's eyes out and actually does injure someone, then that person is heading for jail because they knew they had the potential for injury and did nothing. Same applies to telepaths, if they wander around thoughtsdropping and do nothing to actively train themselves not to (note in the Marvel-verse, yes they can train themselves to tune out) then they are showing the same callous disregard.

And that is just with passive telepathy. If they are doing Emma-comics-Frost's fave trick of screwing with a person's mind and leaving all sorts of nasty little booby traps on certain words and rewriting personality, then they ought to be facing old sparky.

But they are not hurting anyone by just reading thoughts. If they used what they read to hurt people (blackmail, cheat, whatever) then yes that is bad.

okay that's not actually true. My brother has Tourette's and one of his tics is making an involuntary motion with his arms stuck straight out. He ended up getting his fingers tangled up in someone's hair in a store and hurting them. He didn't get in trouble for it. It was an accident.

It's rape if they actually interfere with your thoughts, without permission (change them, block them, booby trap them). Otherwise it's just voyeurism, and although you're using the word just for its shock value I'm sure, I find it really disturbing.
