I always figured they pulled that 'no better than the bad guy' stuff because it was a way to hand-waive keeping around the popular villains. And as someone who often finds the villains much more interesting than the heroes, I am fine with this.

But that's fiction. In real life, I also think it's nonsense. If you have some guy who keeps killing people and blowing stuff up and terrorizing everybody, then I'm not going to be sad if some hero offs him. Quite the opposite.

+1 to this. The Joker isn't a realistic evil dude, he's a story, and one that is more entertaining to keep going. (Plus supervillains are a metaphor for all the bad shit in reality that never really goes away.)
