Most supervillains just need to go to jail and stay there. The Joker, however? He needs to die. He's a fantastic character. So fantastic that he eclipses the most popular superhero in the world, but there is absolutely no reason for Batman to let him live. Everyone wants the Joker dead. Even Harley (because she belongs with The Riddler.)

If everyone wants the Joker dead, how come a jury has never given him the Death Penalty?

Well, except that once. However that time he turned out to be legitimately not guilty of the crime he was sentenced for, and they had to let him go in accordance with the law. However, he's been dragged infront of a court plenty of times since, by Batman mainly, and never re-sentenced to death. Say what you like about Batman, dude is doing his part. He is dragging the monster in front of the courts for the citizens of Gotham to do their part. It is them who aren't "making the hard decision". If the clear and expressed will of the people is that Joker should be allowed chances to keep murdering them, then Batman should not be acting in a paternalistic manner by ignoring that clear and settled expression. The guy is not The Punisher, maybe you all are reading the wrong comic. Go read about that damaged psycho instead of this damaged psycho.
