I think the vast majority of people in the Internet age with an IQ of at least 75 and no severe mental or social disorders would hit at least 100. The society depicted is only functional in its current form because folks were born into it, and their life experiences were carefully limited. (Keep in mind that from what we see in season 1, the scores don't measure capacity to break the law, but capacity to understand the mindset of a lawbreaker. Just reading mystery novels could theoretically push you over the legal limit!)

It's implied that the morality behind the logic is important.
That's why Akane's pass stays clear despite her increasing ability to understand a criminal without her being asymptomatic.
