She's completely covered, in a public place, and the person taking the picture is sitting across from her, which means they're in the same public place and visible. There is absolutely nothing remotely illegal about this picture.

The thing is, she is not depriving anyone of a seat. There is no-one having to stand up because of her.

Also, there is no-one who would be putting themselves at risk by asking her to move. If she were a man, he could and would sit like that regardless of whoever else needs a seat, and knows that if any woman asks him to move he can do significant harm to her, so he really has no reason to site like a civilized human..

And for the record, I've seen women IRL sit like that. Not as many as men, not by far, but enough to take it out of the "never happens" zone.
