The non-creepy thing to do is also assume creators of original work wouldn't like fanfiction and fanart to be made. I mean, a lot of them have explicitly said they're against fanworks. But we'll defend those until we're blue in the face.

The way it's subjective is that we don't think it's creepy if we're doing it, and if the majority of people in our community think it's okay.

False equivalence... Fictional characters cannot object to being used as fictional characters. Real people can object to being used as fictional characters.

(I'm not dismissing out-of-hand the argument that unauthorised fanfic may be considered wrong, but the reasons are different, as is the potential creepiness factor.)
