I don't think drunk sex is necessarily rape. He may have wanted to have sex with her before he began drinking, just like couples have sex and get drunk beforehand aren't necessarily raping each other if the consent on both ends was understood.

According to the story as she herself tells it, he called her when he was already wasted. And also was falling asleep repeatedly.

Then at the very least, she was someone unconcerned about the possibility of being a rapist, if not necessarily a rapist.

I say that because the guy may have decided he wanted to booty call her before he began drinking then done in after drinking, we don't know, since we don't have his side of the story.

Please don't use the gender reversal argument, because they don't matter to me. A woman could as easily decide she wants to have sex with a guy, get drunk, and call him later.

The alleged victim has the final call on whether it was rape or not, not random internet strangers with only one half of the story.

But this is internet social justice, don't you know? We're more interested in punishing the perps for what we have judged to be crimes than helping the victims or even hearing what the victims have to say about the situation. Unless it's to thank us for being the warriors of justice we are.

I know most of this stuff is trolling, but just for the record, I want to point out this post and how fucking ridiculous it is, and that it's exactly the kind of rhetoric that's used to apologize for and justify rape and defend rapists? It's exactly the rhetoric.

I think one of them is saying that Amy S was fine in her action, and another one is saying that she was not. Can't figure out which one is which.

I'm the one that laughed at the other anon's outraged reaction, let me clarify my position.

My opinion is that when anyone (let's call them A) has sex with another person (let's call them B) who is drunk without prior consent given while B is sober, they run the risk of being a rapist. Maybe B consented beforehand but didn't tell A, but maybe B didn't, and that's the problem. The simple solution to avoid all risk? Stop having sex with drunk people who have not given prior consent while sober. It's really quite easy.

Shumer may or may not be a rapist in this instance. We have nothing from the victim's side and an incomplete story so I would not feel comfortable stating she definitely is or is not. However, we do know that she had sex with a drunk person, and therefore as explained above, was willing to run the risk of that being rape. If it turns out the guy was willing while sober then it isn't, if it turns out the guy wasn't, then it is, but there's no way to tell that from where we as internet anons sit.
