If anon is being a nitpicking pedant, then in a lot of areas, no penetration by a penis means it's not legally rape. It can still be sexual assault though.

Wrong, oral penetration or penetration of any kind is still rape in most areas, legally.

Oral penetration doesn't count as rape where I live, but would still be a severe sexual assault. The point remains though, the penetrated party is the victim.
