How worried do I need to be? re: torrenting

(Anonymous) 2016-05-13 11:32 pm (UTC)(link)
I got an email today stating "Notice of P2P Infringement Allegation" saying that "A copyright owner has sent Comcast a notice claiming your Internet service from Comcast was used to copy or share copyrighted content like a movie, television program or song improperly."

This is the only email of it's kind that I've ever received. It was followed by by an email saying that it was "acknowledge" by the company.

Question is: How screwed am I?

Pretty sure in most places you get three strikes? Maybe stop torrenting for a while.

Will do. I found my old external harddrive with all my stuff on it, so I should be good for a while.

Sending you a notice via email seems sketchy from a legal standpoint, especially if Comcast was notified, who would have your mailing address. Are there any indications that it could be phishing thing?

If it is, they have my full address, which is weird/scary.

I'm actually curious since where I live people CAN'T get caught pirating for privacy laws etc: what are the punishments there in the USA?
And... do you actually have people who don't pirate NOTHING all their life?! Here's is just unthinkable lmao

Fines can get pretty steep. And in my 30plus years of life, I've pirated maybe 5 songs all when I was in high school.

I don't pirate anything I can buy or rent. If I like a show or music, why wouldn't I want to support the creator so that they can make more?

Do you have any idea how USA high statutory damages on pirating are? Anon's family could be bankrupted.

Don't break the law if you can't afford the consequences.

Speaking from not-personal experience, I've known quite a few people who get those notices and usually it boils down to 'stop doing that or we aren't allowed to give you internet anymore.' People do occasionally get dragged to court, but P2P sharing is so common nowadays that most people just get warnings. I would contact your service provider, and also maybe not do any downloading.

EDIT: Someone pointed out it may be a scam. I do not suggest contacting your service provider to say 'I illegally download things' unless you are certain the notice came from them, and even then, you probably shouldn't admit to anything if you don't have to.

Coolio, I'll keep that in mind. I'll just lay low for a while.

Like I said above, if it's a scam, it's a scam with my full name + address, which is weird and a little scary, so I'll just keep an eye out.

Where are you located, OP? In Canada these notices are literally meaningless right now, as it is illegal for your ISP to provide your personal information to any third party, alleged infringement or no. All you have to do is not respond to their request to provide it yourself.

As far as I know from my American friends, it works on the strikes system. that said, it's time to invest in a peer blocker if you haven't already.

Oh you can still seed with a peer blocker, it just blocks known company torrent monitors.

Could you recommend me a good peer blocker? I know literally nothing about them, just that they're a good idea for people who torrent often, which I do. I'm Canadian, so I don't have much to be worried about as things currently stand, but it sounds like getting one might still be a good idea.

Can't tell you how much you're screwed because where I live we don't get those warnings, but use VPN clients when torrenting the next time. Saves you lots of trouble!

Do you live in Canada?

If so, not screwed even a little.

if you didn't get a physical letter you're not in danger OP, don't worry

and if you're feeling scared, remember that streaming is a perfectly viable option if you wanna watch TV/movies

The first time I got one of those, it actually disabled my internet until I called them to turn it back on. My strategy was to just deny it was me, I said my friend must've done it when I let her use my internet and that I wouldn't let her use it anymore. My ISP even said that torrenting was fine as long as you didn't seed. It happened after I accidentally let something seed for a long time.

After that I got a peer blocker and figured I was fine, but still always deleted torrents the second they were finished, and it was a long time before it happened, but I ended up getting another notice. That time I had to fill out some online survey thing acknowledging that I got the message and I wouldn't share copyrighted content anymore before I could get my internet back.

Since then, I've been terrified of torrenting, and I finally torrented a couple ebooks a couple weeks ago after not torrenting anything for a few years. I figured ebooks were probably less risky since there's less of a demand for them and they probably don't have people monitoring torrents.

Anyway, unless I'm mistaken there's always a risk with torrents, because it's impossible to not seed them at least a little, since other people are downloading from you while you're still downloading (at least that's my understanding of it).

Nowadays I do a lot of streaming for TV and movies, and direct download from sites that allow it.

Someone has put their work hours into what you steal. Do you think they deserve to get paid for their work? Do you want them to continue doing what they do? Do you see the connection?

da

Yeah. Totally not what OP was asking about.

Until the notice comes recorded delivery on paper then you are 0% screwed.
