2) Alright, let's assume they did this on purpose. They went out to kiss knowing someone would take a pic. Unless the person taking the pic was told to do so BY THEM, they also don't know this and are therefor still taking pics of someone they think doesn't know, so that they can make money off of it. Still morally bankrupt!
And I go back to 3) Paparazzi culture is fucked up and yes, it's still possible this was not set up. It's summer. It's hot. People go to the beach. Don't sell their fucking pictures to magazines. Legal right and moral right are two different things.

Presuming it actually was a public place, yeah, I'm sure they did know. But I don't know why anyone would ascribe any sort of negative motivations to their actions, when the simplest and most sensible explanation is that they simply don't feel like sneaking around when they're not actually doing anything wrong in the first place. So they picked their moment (which is basically the only control they have in this situation), and gave the paps their shot. It's what I would have done.
