Do you ask when you use official art? No. There is no difference here, because even using that has its problems. Learn this fact, please, and think it over.

Also? I am an artist. And I wouldn't give a care if someone used my work. Once it's on the internet? It's free game. So whatever. and have my icon for good measure.

There's a big difference -- the artists who draw the official art get paid for their time and effort. Fan artists do not.

Just because you CAN do something doesn't mean you should. Just because you don't agree with someone's else's desires for their work doesn't mean they are wrong.

You're an artist. Have some respect.

Actually? I do have respect. I credit sources from where I got them in my icon posts. But it's my choice to do that. If people decided to use my art and not credit? I don't care. They can do whatever they want.

Using official artwork is illegal. You technically need some type of permission so you know, we shouldn't be using that either. Both is bad, we still do it.

Well, I was all prepared to go on about this for a few paragraphs, but justaminuet did that nicely for me already. But at any rate, it doesn't have much to do with what I intended to get across.

My point was -- if you don't care if people use your art/fanart without asking, fine. But some other people do, and they can legally do with it what they wish. I meant that you should have respect for them.

I think you missed what I originally typed. :/ That whole last part was only reffering to myself, as the secret seemed to be going into general artists and I'm not part of that crowd.

If people want to defend their art? Fine, I can get that.

Not to ruffle feathers, but there's a difference between copyrights and trademarks. A character's design is trademarked. Therefore, fanart easily falls under fair use laws, as long as artists aren't making money from it. Official art falls under both trademark and copyright. There's a reason why Japanese fans can make fan art all they want, but you never see them use official art on their websites.

The main reason why American companies don't go after people who use official art (though they legally can) is that it is A) far too expensive, given the amount of use official art has, especially on the internet, and B) it would completely ostracize and villainize them to the consumers, which would be a very, very bad thing. After all, you don't want to threaten the people buying your merchandise.

Also, think of it this way: I've had my artwork used (without permission) for icons here on LJ. Yes, it was fanart. I was able to contact LJ (when said icon maker refused to take it down), and they forced the user to take the icons off their journal posts. Because, while the characters in the picture were trademarked to their owners, the picture itself was copyrighted to me, since I was the artist. I admittedly make no money on fanart (nor do I have the legal right to), but it is still legally my artwork.

Again, don't want to start an argument. Just food for thought.

Yeah, I knew about the copyright thing. It falls under derivative work, which has the fair use policy. That's why I didn't say anything on it, just official work itself since I knew fanart is protected.

I don't mind if it's against the law or not - I don't mind if people use mine. The only thing that really bugs me about fanart is claiming it as their own, or "art theft".

Though I can understand where you're coming from, though. I'm not trying to attack you.
