It's not illegal to drive if you're under the legal limit (though that can vary from state to state), but the problem comes when people misjudge that. And having characters that you root for casually drinking and driving sort of normalizes it. Like, someone might subconsciously think that it's fine to drive after a couple of beers because they've seen it so much and not really think to account for the difference in body type or tolerance.
