Depends on what view you look at it from.

Legally no, as regardless of whether or not it should be legal, it is currently illegal. You could take the high(-horse) ground of someone who would smoke if it were legal but doesn't yet because it's not.

Morally, probably hypocritical, but it depends, again. Is he bothering other people with his smoking? Is he That Guy in the apartment building that constantly is stinking up the hallways and hotboxing in his room? Are you reporting him because his smoking adversely affects you or because he's an asshole and you want an excuse?
