Wow, it's impressive how many conclusions you manage to jump to in the course of accusing other people of jumping to conclusions.

Referencing is a useful artistic tool. Photomanipulation is a practiced skill. Tracing, on the other hand, is plagiarism. If I'm writing a piece of fanfic, instead, and I borrow someone's story and fill in different names and places, there's no talent required. That's not using the wrong technique to create something, that's cheating.

BS. Once again, the only reason you think that is that you haven't tried it yourself, and/or you haven't seen a good vector artist specialised in tracing.

Riiiight. And that's why you never use other people's characters in your fanfiction. Like, never. Even the canonic ones.

BTW, whom again am I plagiarising if a part of my picture is taken from a traced photo which I just made for this only purpose? I would highly appreciate your help in this confusing matter!

As an artist who does occasionally use reference photos, there's a huge difference between using a reference and doing an overlay tracing. Honestly, I don't even care if someone does an initial overlay rough sketch of a stock image to just get the proportions down right, but this artist blatantly traced down to the exact details. There was no creativity put behind it, which sure she has some talent regardless, but art as a whole is creating something new and not simply painting over an existing photograph. She also has a history of doing this. I always knew she was tracing because it was fairly obvious and yet she never once even has credited a reference photo.

If you're tracing your own photographs that you took specifically for the purpose of drawing a particular pose, that's another thing entirely. You created the pose, the photo, the drawing and I personally don't have a problem with that -- I only reference my own pictures just for the sake of originality. The artist in question was using a copywritten image, did trace over the original and made little changes from the original photograph in her artwork.

Vector artists and photo manipulators are an entirely different type of artist. They specialize in using other images and then credit the images used. While I can digitally paint, I haven't a clue how to photo manip and do consider quality photo manipulation to be a form of art. Same with vector. However tracing a copywritten image verbatim and then proceeding to deny it repeatedly isn't cool.

I've never known anyone who would really cared about what methods an artist uses as long as they're honest about it. The problem is, most aren't and in the end when they do get caught a lot of people feel misled.

Maybe our misunderstanding roots in the fact that I don't have any idea who is that "artist in question" you accused in the original post. Apparently, I agree that complete tracing with adding nothing adds nothing (except for quality - I've done a couple of traces myself when people needed a hq version of a screencap that was like 100 px wide - it's work, but it's not art).

And, of course, explicit refusal to credit is also bad.

However, I still think that the problem and the limits of ref usage lie in how you use this method, and aren't inherent to the method itself. Even you said that tracing your own photos is ok. On the other hand, in the original post it was implied that: (1) all referencing artists suck, (2) referencing is plagiarism, and (3) if a picture is good, it is already the reason to accuse the artist of plagiarising an unknown photo. Sorry, I still think this is bullshit.

As for (1), no, only those who don't any creative value are bad.

As for (2), also no. I am an administrator of several wiki-sites, and I know a thing or two about licensing. If the picture is referenced for let's say a pose, this part is considered public domain because it is "trivial" (legal term, not an insult). This basically means that if you could've possibly sit in the same pose and make a picture of yourself, you don't have to do it, you can just use my photo. If there is something unique in the photo, then yes, it is eligible to copyright.

As for (3), it's just stupid. Don't blame the fandom for bugs in your head.
