I don't know what's legal, but you might consider complaining to your credit card company. I get a lot of emails from stores (and theaters, and museums, etc.) but they were all times I gave out my email. I don't think I've had it happen with my credit card. I did move recently and was surprised how many places found my new address without me telling them. My undergrad alma mater must have gotten the info from the post office, but the grocery store could have gotten that from my credit card.
