It depends on how you commissioned it. Legally, you are allowed to criticize and expect better work if it defers from what you were expecting. But really, it you're ordering from a company whos business is to create furniture, then by all means send it back. (nine times out of ten they will appease whatever concerns you have, so long as you're persistent) If it's a lone person/business that you're buying from, it can be a lot more complicated. They might redesign their work by the love of their craft, but as it takes so much time and work to build such a thing they might be reluctant to do so...

Honestly, just check the records of the sale, their warranty/customer service standards. I assume the answer to your question is somewhere in there.
