So not major things everyone knows about like the Holocaust or slavery. Everyone (reasonable people at least) know about those.

Claudette Colvin. She did the whole refuse to give up her bus seat thing before Rosa Parks. But because she was a single mother, she was passed over for Rosa. Not that Rosa Parks wasn't amazing. But so was Claudette Colvin. And she doesn't get acknowledged nearly enough.

Vietnam after WWII. Ho Chih Minh was a leader of the Vietnamese resistance, funded by Allied governments up until VJ day. At that point, not only was the independence movement shut out of peace talks, the British army conscripted Japanese POWs to protect food supplies for export to France.

Some anti-communist resistance cells and refugees in Eastern Europe were sold out to Stalin as well. "Great job fighting Hitler, off you go to Siberia!"

Stella Liebeck aka "McDonald's coffee lawsuit". A lot of people still make fun of the case as an example of "Americans LOVE to sue people." This is ignores the fact the coffee was 40 degrees hotter than it should have been. It was so hot, it fused her labia shut when it was spilled on her.

Lindy Chamberlain aka "A dingo ate my baby" woman. This woman was imprisoned for four years. Even worse, the whole situation was made into a joke you still hear today (and thus the mother likely still hears today in movies/tv). It was a freak accident that proved her innocence. A climber died and was not found for a while. Police were searching for the bones of the climber and happened upon some clothing of the child.

Yes to both of these, but especially the first one. Although, lawyers know that her case was legit. At least, we studied the case at my law school. But her case is such a big example of how what people think happened doesn't actually match the reality. And she's actually an example of when things actually go right in court. McDonald's deserved to lose that case, and they deserved to get bad press. A shame that the public impression of the case has exonerated them.

Because McDonald's settled with a NDA on her end, so she has to listen to the lies but can't speak up.

Right. I'd forgotten that bit. I speak up every time i hear someone mention the case. But the disinformation goes really far. I feel really bad for her.

It was her decision though, wasn't it? Signing the NDA was presumably part of the settlement she received from McDonald's.

McDonald's would have put it as a condition of their settlement. I don't blame her. She was up against a major corporation and had no idea what she was doing. Her attorney, on the other hand, that person I do blame for not at least having the NDA go both ways.

Her choices were continue an expensive court case for an unknown amount of time, because you KNOW McDonald's would have fucking stalled it into eternity, or accept the NDA and get coverage for her medical bills

Yeah, when I first heard the story as it's commonly told, my impression wasn't "elderly grandma", my impression was some blonde Paris Hilton type. (Since I heard it in 2003.) Poor Stella Liebeck.

Holy Shit yes (and oh my GOD that sounds painful)

This German guy in a server I was in started making fun of it and I got really fucking mad at him for it enough to actually try and argue it because I studied it in law class.

Also that second one is pretty awful too, that poor mom.

that was NOT the point of my post

as much as i detest the "fixed lol" construction of rewriting other people's quotes, the op's "when it was spilled on her" implies (i'm sure very deliberately) that the spillage wasn't her fault, that somebody (or something) else spilled it on her like it was a goddam acid attack or something, and that is the most disingenuous and weaselly shit i've read in a long time

especially when the discussion about fault for the spillage is the ENTIRE REASON there's ever a conversation about the case

the coffee was 40 degrees hotter than it should have been - according to whom? - 'The National Coffee Association of U.S.A., Inc., recommends that the temperature of a coffee must be maintained between 180°F and 185°F (82.2°C and 85°C) for optimal taste' and McDonald's still serves it around that temperature. It is really hot, but coffee is supposed to be brewed 190°F and 205°F, so fresh coffee is really hot. It did cause serious burns to her. But my issue with thinking the lawsuit excessive was more about the fact that she spilled it on herself (I know she wasn't driving) - if the lid hadn't been secured or if it had happened when it was handed to her, fine, but that's not how it happened.

The problem was it was over 205. Like, legit. It was brewed as hot as it was because "people don't drink it right away."

Uh, no, 180F to 190F is what you'll find if you look up the facts of the case - like here: https://injury.findlaw.com/product-liability/the-mcdonald-s-coffee-cup-case-separating-mcfacts-from-mcfiction.html.

That is absolutely hot enough to burn seriously. I am not arguing that it isn't hot. Liebeck's attorney argued that it was much hotter than other restaurants served it - very likely true, at the time. They also argued that having it at a lower temperature would lessen the chances of burns, which is true.

McDonald's needs to make them sturdier so that just holding them slightly too hard doesn't make them explode all over you. That's the crux of the issue.

This isn't about McDonald's, really. It's about the fact that she put the coffee cup between her knees and pulled the lid off, upending the coffee in her lap and the jury found that she was only 20% liable for that. I do not agree with that. And I wouldn't agree with it even if it was, you know, Enron or something.
