While I think art_theft is a huge problem and people should be vigilant against it and do their part to inform the original artists and report the theft, I can't really agree with what you're doing AT ALL.

So you're running to artists and telling them people are "stealing" their art by cropping a 100x100 box and not putting their name on it?

Unless you also run around contacting companies and professional artists, directors, cameramen, photographers, font creators, etc. that people are using their materials in icons without credit, you're placing fanart on a pedestal above any other visual form that can be used in icons, and that's ridiculous.

Is a picture of Naruto cropped from a Deviant Art submission being used without credit somehow a worse injustice than a screenshot of Naruto from the anime, or a panel from Kishimoto's manga?

I guess we just have different views. I don't see it that way. I suppose a part of me is a little dumb (let the jokes begin from this quote!) and just thinks "At least people know it's the official art and can easily find out who drew it". Plus the fact I will never really know those artists, but can easily know the fanartists this does bother. You have a good point, though.

I credit _everything_ I use for my icons, because I think it's only right and fair. Still, I wouldn't get on to other people for not doing it just for fan art. As long as they're not claiming they made it, I don't see what the problem is. If someone asks them where they got it, and they tell them, or tell them they don't know, it's not a problem. [I'm sorry if this is incoherent - I'm super tired. I do appreciate you responding, at any rate.]

They can have their own legal departments deal with it, fan artists can't afford that.

Fan artists also don't have the right to bring any sort of legality/ownership suits against anyone, either, so money for lawyers are a moot point.

I don't necessarily agree with the secret--something about the tone of it bugs me--but this has always struck me as a rather disingenuous argument.

1. Official art is essentially credited by default. All it takes is a quick browse over to Wikipedia to see who the mangaka and/or animators are if you want to know, and people who are actually in fandom and therefore likely to pay attention to the icons in the first place probably already know (at least in the case of the mangaka). It is often impossible to find the credit for a fanart icon, even if you try.

2. By putting their work out for public sale and, in most cases, allowing tons of merchandise of it, the creators have already tacitly given permission for fans to use those images so long as they're not profiting by them. Of course you can argue forever about this with the more legal-minded, but in fandom, at least, with all its fanart and fanfiction, this is the accepted view. The products of other fans are on somewhat more shaky ground--yes, they're usually out in public, but they're not always or even often sold. People will have different opinions on whether fans should credit each other for their work. But in my opinion, while the creators are usually somewhat removed from fandom and are unlikely to ever care what we do with their images so long as we don't shove it in their faces...fans are all in it together, and therefore it behooves us to respect each other's wishes in regards to personal works.

But the OP doesn't say they are 'reporting' people for using icons of fan art the fan artists have asked not be reproduced or edited, they say they're 'reporting' them for using something and not crediting it. Using that MO, they are bound to contact several artists who don't mind or have given permission for derivative works, simply because the icon maker doesn't credit. There is also the fact that many people have images that they have found that in no way indicate the original artist - they may not be crediting them because they simply don't know who they are.

Look, people, yes it's easier to find out who drew official art. And yes, if you're using fanart, giving people a link to the artist is definitely, definitely the polite thing to do.

That said, there is no theft out of taking a portion of a piece of art, and making it smaller. You are not claiming to have drawn this. There is a world of difference between taking an image and just putting it up and going "I DREW THIS!!!!" and having what amounts to a 100 x 100 display of appreciation for someone's work.

Also, the argument that because people get paid for published work, that makes their works more "acceptable" to use for icons, fiction, etc, is pretty much backwards. Logically, if someone is being paid for something and you're "stealing" from them and not getting paid, you are causing them more hypothetical harm than "stealing" from someone who drew for the love of it and isn't getting paid, without profiting from it yourself.

When I icon (what very little iconing I do), I think "wow, this is beautiful. I love this." Whether it's a canon image, doujinshi, fanart. Doesn't matter. When I see other people's fanart icons, I think "wow, I wonder who drew that?!" I seek it out, if it's credited and I can find it. If not, I'm disappointed, sometimes make an effort to find the artist anyway. If I stumble across them in the future, I'm thrilled!

But guess what? If I hadn't seen that icon in the first place? I wouldn't know nor care two shits about that artist's work, and proably be less likely to ever see it. So what it really boils down to is pigeonholing free publicity (credited or not, though credited is far preferable) as theft, despite the iconist having nothing to gain and the fanartist having nothing to lose.
