In the real world in such cases people who use someone else's work like that, they need to pay money.

That's because they're actually actually using somebody else's livelihood to sell their stuff. They would, in effect, be stealing money from the artist. What does a fan artist lose from having their art used in icons?

if you don't give credit, by default people assume that's your work.

I think you're mistaken. I don't think people assume this when it comes to icon makers. In fact, I think most people assume that icon makers always use other people's images for their icons, as they see the icons as works of art in an of themselves.

I don't know, this is kinda grey area where different people can have different (yet strong) opinions about. It's less about losing anything, and more about possibly gaining something. More like in blogosphere: if you blog about something you've read somewhere, you usually tend to give a link to the source so that all sides win: your readers can go there and read the whole story, and the original author gets more views. It's really a win-win.

When it comes to fanart, I even maintain that the using side is losing more than the producing side in case of credit absence. I draw too (not from this account), and I only feel happier when I stumble upon my art in other people's journal designs, fanwebsites, forum posts, 4chan threads, etc (never seen anyone make icons of it, but I hope this time will come :) ). Maybe this is gonna change if I ever start taking commissions, but now I draw only for the fun of it, and noticing others thinking it's worthy of using/reposting is fun too.

On the other hand, I constantly see uncredited fanart used in icons, and even when I ask for the sauce, some of the iconmakers reply with "dunno, found with photobucket/google/..." That's sad: someone drew this, someone talented, someone who has perhaps a whole gallery full of pictures like this, and someone who could probably be stimulated into drawing more awesome art by getting more views, favs and nice comments.

PS: I'm not replying on the second part of your comment: yeah, I might be mistaken, but the two of us don't have enough statistics to solidly conclude what most "people assume".

Well, I'm certainly not arguing that people shouldn't credit the creators of the fanart they use in their icons. It's absolutely the best solution that they do. I just don't think that they've wronged someone, or committed a crime if they don't.

Yeah, it's annoying, but it will inevitably happen as soon as something is posted in public online. I'm pretty sure icon makers who like a piece of art enough to use it in their icons would like to know who made it, but sometimes they really don't know the source.

That's why I try to avoid stating my opinions as fact; even though I've observed this behaviour, I have no way of knowing if it's universal.
