According to U.S. copyright law, using someone else's intellectual property isn't legal, though some argue there's a lot of gray area in terms of fair use, derivative works, etc. Making money off someone else's IP is definitely not legal, but it's not commonly prosecuted so it's like jaywalking... tons of people do it and don't get in trouble, so many people think it's legal. It isn't.
