Yep, if it's just people doing it for fun, then people like Anne Rice look like jerks. But if they're making money off it, then that gives creators and copyright holders bigger reasons to crack down. Though it sounds like the writer in the secret isn't making money off fanworks per se, if the names/settings/characterizations are changed as much as OP says.
