Actually, you're kind've right about that, but likely for different reasons than you think.

In Diplomatics, the science of analysing the form of documents and records -- generally in order to ascertain their authenticity (it's related to paleography, the study of script) -- there are a number of persons who can be responsible for the generation of any document or record.

The writer of a document/record is the person who wrote the text. The author of a document/record is the person who has the authority to create/issue that document or record. So, for example, if a lawyer has his assistant write a business letter to a client on his behalf, the assistant is the writer of that letter, but the lawyer is the author, because he is the person who, given his position and qualifications, has the authority to issue it.

In the same sense, this kind of applies to original works and fanfiction. The creator of the original work is the author of that work -- he or she has the authority to produce the material due to copyright, agreements with publishers, his or her own creative ideas, etc...

Any person who creates fanfiction within that author's universe is only a writer and not an author, because they do not possess the legal authority to produce official works in that universe.

Make sense? Probably not, but it's amusing to think of fanfictionin those terms.

Er, and I kind've left something out.

The author and writer can be the same person -- so if the lawyer wrote the letter by himself without asking his assistant to do so on his behalf, then he is both the writer and the author of the document. This would apply to any person who has written a book -- they came up with the idea and were able to get it published, etc... so they are both writer and author of that work.

I do not think this would apply to fiction quite so neatly because published Fanfiction is listed as authored by whoever the person who wrote the words. (Dragonlance books, Star Wars books, movie novelizations) All fanfiction, but published with permission.

You're right that diplomatics doesn't apply to fanfiction very neatly, but in a general sense it's an interesting way to think about it. Diplomatics was originally intended to be used only for medieval documents anyway and doesn't always work particularly well with many modern and post modern documentary forms.

Officially published fanfiction definitely complicates it and I don't have a ready answer for it. There are other exceptions to be found as well, such as ghostwriters. VC Andrews novels are an interesting example of this (oh god, I hate VC Andrews, but I think how her novels work nowadays are hilarious).

So, VC Andrews wrote about 8 novels or something, but for years now, a ghost writer has continued writing novels under her name (the ghost writer has actually written more VC Andrews novels than VC Andrews herself). In this case, it is difficult to establish writership and authorship, since this writer has the authority to publish those novels, but only under the name of VC Andrews and not his or her own name.

There's no easy answer, I'm just kind've thinking out loud. It's interesting for me to think about the fanfiction/official works issue in those terms.

But ... what about fic in public domain fandoms (such as the fifty million Austen spin-offs) or in fandoms where the creator gives specific permission to her/is fen to play unto their hearts' content in said creator's sandbox?

Whether the author gives permission for the creation of fanfiction or not doesn't change anything. To an archivist, or likely to a lawyer, the original creator of the work is still the author and the fanfiction would likely be the work of only a writer.

That said, some diplomatists might disagree with me -- Diplomatics was originally conceived to be used on medieval documents, which all had very particular forms and rules for generating them. It's more difficult to deal with modern and postmodern documents -- especially with fiction.

As regards public domain works -- Jane Austen is still the author and writer of her original works. That doesn't change -- the thing that gets complicated is other officially published works.

As I said above, I'm not really trying to agree with the secret poster or whatever else, just thinking about all of this from the point of view of an archivist. It's not as simple as I made it seem in my original comment at all -- provenance and authenticity are issues and concepts that we will always struggle with.

While fanfiction =/= Diplomatics, and the OP doesn't really have any room to bitch about incorrect word usage when they tagged that "faggot" on the end of their secret, that was pretty interesting to read. Thanks. :D

Yeah, it's totally true, but I found it interesting to think about as soon as I saw it. I thought it might be a bit cool to turn the words of an obvious troll/idiot into something that made sense ;D

And no, fanfiction =/= diplomatics, but my professor in graduate school who taught it argued that you could even diplomatically analyze graffiti, so I suppose it's possible if you look at it the right way :)
