Wouldn't it be sort of, uh, humiliating to get caught for that and sued, though? Being known in real life for writing smutty fanfiction would be embarrassing enough, but on top of that, I'm pretty sure most people would not be very sympathetic toward someone who stole paragraphs of tripe from bad romance novels.

Can you really be sued for plagiarizing things in your fanfiction? It's not like you're making any money off of it.

I feel like there's been at least one case of that, but I may just be getting mixed up. I've heard that a few authors get irate about fanfiction of their work in general too, but I'm pretty sure that's mostly just fantasy authors and probably not romance authors.

Yes, you certainly can be sued for infringing someone's copyright in your fanfiction. Whether the infringing work is competing for the same market as the work it infringes is one of multiple factors by which such cases are assessed, but the idea that you can't be held liable unless you're making money from the violation is wholly incorrect.
