In a way, I kind of agree. I get that Mark and all his friends couldn't get work and it's not entirely their fault. That said, they still can't act like Benny is evil while they are breaking the law.

They aren't breaking the law. That's why Joanne says they have a case; they're squatters.

They made a deal with Benny to live rent free in the building after he bought it. After a year, Benny unilaterally revoked that deal. Because he presumably made no effort to collect rent from them during that year, he gave up certain rights to collect rent from them after the fact. You can't never send someone any bills, and then suddenly ask them for an entire year's rent all at once. (Unless of course that's the payment plan you've set up.) Benny can kick them out, but he can't force them to pay him.

They say this at the beginning of the show; it's very clear. Bad on them to trust their friend and accept a verbal agreement in good faith, but they did have a deal with Benny. They weren't just being layabouts or ducking out on paying him.

I think—and hopefully some lawyer will come in to correct this—that you have to enforce your property rights by coming by and kicking them out. If you have people living in your abandoned building and you don't bother kicking them out over a period of time, then they have squatter's rights and that's a whole common law thing about what rights they have and what rights they don't, one of which is that you can't kick them out with no warning; that in not kicking them out before, or demanding rent, you've entered into a common law agreement that they can live there. I think it's sort of like if you don't enforce your copyright you can lose it.

If they've been there over a month, they have squatter's rights, yes. You need to give them eviction notices, 30 days' warning, etc etc and so forth

NYC has the best rent laws in the world because --> even the rich exclusively rent there.

That is true. I haven't seen the show or movie since the tenth grade, so a lot of the details are fuzzy to me.

I tell you what, I had a lot more sympathy for the rest of the cast back before I had to, y'know, pay rent. If I can get it together, if I'm not too good and too much of an artist to pay, then Mark and the rest should pay it, too. Dudes, take a wait staff job like every other aspiring artist in Manhattan.

I get that, but. I wouldn't pay rent either if my landlord was a wealthy friend who told me that I didn't have to.

(I have only seen the movie- I have not seen the Broadway production. I understand there are differences.)

I've got some sympathy for Roger, because I recognize that keeping a job while being HIV positive in the eighties was likely difficult. But I've got NO sympathy for Mark at all. Period. He's a snob who thinks that he's so much better than everyone because he's an artist, and I'm sorry, but no matter how good you are, if you can't pay the bills with your art then find another job. If it compromises your morals to work for someone else making film, flip burgers or wait tables. Seriously. If there had been any indication that Mark had been looking for work I would have had a lot more sympathy, but sometimes you have to do what you have to do to pay the bills before you get your break.

Also? His attitude towards his parents- who dared to call and say "sorry about your breakup, but we think you're great and happy holidays!" (okay, maybe not very sensitively and PC, but not evilly) - is just annoying as all hell. Maybe they weren't using all the right language, but their intentions towards their son were supportive and at least positive and... ::Grumbles more::

At least from the movie, I never thought Benny was all that bad. (Although I understand the musical is quite a bit different.)

Not even going to lie - the entire premise of the movie irritated me. You can't just take someone at their word that they'll never charge you rent. Either get it in writing, or else save your money for when they inevitably come to collect.

Different time, different context. If you were actually living as one of the characters in the show, in alphabet city, in 1989 where all your friends (especially the gay and brown) were dying before the age of 25 and no one cared, I daresay you'd feel differently than you do now, in 2010, when Obama is president, apartments in the lower east side go for $5,000 a month, and HIV is somewhat treatable.

It's interesting to watch this movie with kids/teens vs. adults. The teens are usually on the main characters side and think Benny is evil. The adults are annoyed by the main characters and think they should at least try to get a job even if that means selling out.

But, that's just been my own experience watching it with people.
