I was abused by another child (she was a pre-teen, about 3 years older), and when I talk about my abuse, I generally let people think she was older because I'm afraid they'd dismiss it as "kids playing doctor," and not understand it was genuinely abuse.
That being said, I wouldn't call her a rapist. I'm pretty sure she was being sexually abused by older males in her family herself, and I think she was very wounded and confused when she abused me. You can be capable of doing awful shit when you're younger without having the full capability of understanding it, and thus, being responsible for it.

Also truth: Someone can be raped without anyone being a rapist.
For example; Two children play a game that ends in sex. Later in life one of them finds this hard to deal with. They see it as a sexual assault. However the other child did not rape anyone; they were simply playing a game where one participant wasn't having a lot of fun. This happens a lot when you're a child. You wouldn't say that a child was a "murderer" for not understanding that their friend was having a seizure and that holding them they way they did would be fatal, would you? It's a very unfortunate happening where someone died as a result of someone elses actions, but that doesn't not mean anyone was a "murderer".
Similarily someone with psychosis might honestly believe they can only save someone's life by sleeping with them. They feel forced into it as well, by the voices telling them to do this. In this scenario both of them have been raped, but no one is a rapist. They were both forced into sex they didn't want.

(Anonymous) 2011-07-31 03:58 pm (UTC)(link)A child who doesn't know how to deal with someone having a seizure isn't a murderer if someone dies as a result any more than I'd be a murderer in the same situation. But. Not knowing how to help someone is a far fucking cry from DELIBERATELY KILLING SOMEONE, and there are children who do that, and psychotic people who do that, and they are MURDERERS.
If rape occurs, then someone has raped. If murder occurs, then someone has murdered.

Just like someone who is psychotic who genuinly believes that their friend will die if they don't hold them underwater is not a murderer. They both weren't in a state of mind where they can be held responsible for the their actions.
And, yeah, a person who is forced by someone as a part of their psychosis to have sex have been raped too.
Another example that actually happened to me; I have DID. As in; multiple personalities. One of my personalities has one night stands a lot. To me, that's all rape. Someone had sex with me when I was unable to consent and it's scary and violating. However, they are not rapists. They had no way of knowing that I have several personalities. I was raped, but they're not rapists. They had sex with someone who was sober and enthusiastically consenting. They weren't raping someone.

(Anonymous) 2011-07-31 05:05 pm (UTC)(link)Yep, very true. A lot of criminal laws are all about the mens rea (state of mind) of the accused, and that includes rape. The accused has to know that it's non-consensual in order to satisfy the elements of the crime.
