The thing is, the original creators were actually flattered that Disney did that until Disney denied that they'd taken the idea from them. Even then, it wasn't that Disney had ripped them off they were upset over, it was the fact that Disney flat denied it that pissed them off.

So, at least from my point of view - why get upset over something that the original creators themselves were flattered by?

So... couldn't Disney just credit them?
It's something as simple as a press release or (as I mentioned above, even a phone call) and yet they refuse to do it. A pretty assholish thing to do if you ask me.

I'm not arguing that it isn't asshole-ish, it is. I'm just saying that I don't see the point of getting upset over it it when the people who created Kimba weren't upset over the fact that Disney ripped them off.

Plagiarism is not just an issue of taking but also an issue of not crediting. This refusal to cite sources is upsetting (and in places like colleges and art classes, something that potentially gets people kicked out)

And frankly, I am more upset at the widespread attitude of livejournal users here accepting plagiarism (not just taking without permission but also not crediting) because of improvements.
Ugh, this reminds me of the Yunomi/Just Be Friends scandal in the Vocaloids fandom.

Because in the real world with attorneys and copyright and all that jazz you don't just announce "Yeah, we totally stole 90% of our plot from you. It's an homage!" Disney stood a good chance of winning any copyright lawsuit for a variety of reasons, but they (and any business with a functional business model and legal department) would never "credit" a work still under copyright when they had failed to gain the rights to that work and had borrowed some readily identifiable elements from it. The "credit" would appear front in center on the plaintiff's brief for that lawsuit and Disney would be failing in its legal duty to shareholders.

So why couldn't they just come up with their own shit instead of taking someone else's in the first place? Or at least try to be more subtle about it?

This is still not an excuse for their plagiarism and, more importantly, fans shouldn't be falling over themselves to blindly defend Disney.

Define plagarism as you mean it. Is it taking elements from the work, significant elements from a work, or primarily basing a work on a previously created work?

Do you know where the original creators were flattered? I've only seen one report on one of the animators for Kimba, and the animator certainly wasn't pleased by what Disney had done (which made me feel even worse about the situation).

Agree to disagree, but IMO, plagarism shouldn't be encouraged/allowed no matter what the original creator's feelings are.
