Heh, that's true. Yes, I agree that a dead body certainly isn't capable of choosing a sexual partner in the first place. I guess my problem is that it once was capable of such a thing, and that body belonged (or, depending on how you see things, still belongs) to a person.

I'm honestly pretty surprised that virtually everyone in this thread is of the mind that a dead body can't be raped. I'm fairly certain that American culture, at least, considers necrophilia to be rape. I think it really depends on the way you view a body/soul unit, honestly. I switch between a materialist and hylomorphic view, so generally the way I see it is that it is violating a person since, according to materialism, a person is nothing more than their body. Death is a state and life is a state. In my view, a human body is a person regardless of which state they're in.

Having sex with a corpse is a crime, for sure, but I don't agree that it is rape, and it isn't covered under the same law as rape in my country.

I guess it really comes down to a person's individual belief about the state of the body after death, and whether it retains anything of that which made it a person. I've always believed that it doesn't, and that after death the body is just the vessel that used to house the person.

This whole debate (and I've been reading the comments with interest) feels a little like people arguing over semantics. Whether or not they can be considered as the same crime doesn't matter, both are a crime and both are wrong.
