Yeah, I agree with you, but unfortunately that phrase took off in the fanworks fandom and everyone does it when they start out because they don't know any better.

To play devil's advocate, it's staggering how little people really understand of copyright and trademarks, even today, with resources on the topic available on the internet.

also admittedly, there is a ton of misinformation and wrong information out there as well. it's not just in the copyright/trademark statutes (for the us) but in case law, and interpretations.

not to be the anon who has gone to law school, which you have no reason to believe, but even in the legal community, it's super unclear. there are a lot of good arguments for fan-works, but it's not certain, or easy.

Oh, that is certainly true. What I meant was that there are many people who don't even know what copyright is, or think that yelling "It's a Parody! Fair use!" magically allows them to do whatever they want and sell things that aren't theirs.
