If you're talking about US copyright law, then a lot of times one element a plaintiff has to prove for such things is that it was intended. Saying you didn't intend it would make a better case than if you didn't.

The problem here is that by adding that particular disclaimer, any savvy attorney (which the copyright holders will almost certainly have access to) is going to claim that you're proving you knew your work could constitute infringement of copyright. Which makes said infringement intentional, even if you say it's not.

Unless your talking about legal intent the standard is "did you intend", period. Legal intent, would mean you should have known or that you were substantially certain, which considering the state of copyright, and the various interpretations of fair trade, a thoughtful attorney could talk you right out.

nope! actually, in US copyright infringement you have to prove 1) similarity and 2) access. no intent needed! it can be accidental and unconscious! that's how one of the Beatles got sued!

You mean George Harrison? Yeah, you're right no intention necessary, I was wrong. I still stand by my point that saying you have no intention of infringing copyright goes a long way into proving the first factor of fair use.
