(Anonymous) 2012-01-17 01:49 am (UTC)(link)Illinois doesn't officially have a Romeo and Juliet clause, but it de facto has one (it's a different crime if you're more than 5 years older than the minor, and it's really not enforced if you're within five years of age). I'm most comfortable with R&J laws; let 15 year olds have sex with people near their age, but keep the 50 year olds away from them. I don't trust anyone past their early 20s who wants to have sex with a minor, and the power dynamic is so skewed. In the case of Kash there's a "reason" for it in the storyline, but still... more not-okay than okay, and he should really know better.

I'll just assume I understand you correctly (In Norway it is you turn 16 you are legal and as both parties are okay with it the law don't care about the age difference) So what you are saying is that it is legal for a 14 and 19 year old to have sex? But not for a 17 and 22 year old?
Yeah I just don't like Kash, but I am quite sure Ian went into the relationship with his own free will...

(Anonymous) 2012-01-17 02:48 am (UTC)(link)The age of consent in Illinois is 17. It is also illegal for a person to commit sexual acts on a person under the age of 18 if he/she has a position of authority or trust over the victim.
(720 ILCS 5/12-15) Sec. 12-15. Criminal sexual abuse. ...(c) The accused commits criminal sexual abuse if he or she commits an act of sexual penetration or sexual conduct with a victim who was at least 13 years of age but under 17 years of age and the accused was less than 5 years older than the victim.
Sec. 12-16. Aggravated Criminal Sexual Abuse. ...(d) The accused commits aggravated criminal sexual abuse if he or she commits an act of sexual penetration or sexual conduct with a victim who was at least 13 years of age but under 17 years of age and the accused was at least 5 years older than the victim.

A 17 and a 22 year old is fine. It's completely legal. 14 and 19 would still be illegal but the charges would be lowered because they are both minors; only the 19 year old would be charged.

edit: looked it up, with the exceptions of Pennsylvania (21), Nebraska (19), and Alabama (19), the age of majority in the US is 18, and federal law defines it as such in the legislation I could find. This is different from the age of consent, which is 16-18 depending on state, and most states do have an age gap clause intended to protect minors who are in established relationships before one of them reaches the age of consent. The span of these clauses seem to vary quite a bit, though, and are available on Wikipedia if you really need to know.

I didn't even really think about the huge age difference between the two of them (and the possible ick-factor and or legal issues) when I saw the show, which surprises me now that I think of it. I think I was distracted by how hot the older guy is, and the really funny line where his wife comes in and says something about his mother being delusional because she thinks the CIA is stealing their trash, and the kid was like "Didn't that happen though?"
Anyway, I'm not going to lose too much sleep worrying about the morality of their relationship, but that kid does look *very* young. Some 16 year-olds look like adults, but that kid...does not. So I could see how some could be squicked.
