It would be considered fanfiction, yes, but a) it's obviously supposed to be fanfiction and b) it hasn't been published on the internet for thousands (do I wish I were kidding. These super popular Twilight fics always get tons of reviews) of people to read and review. The latter is the skeevy thing here. If she had just for herself written a Twilight AU story and then published it with different names, go ahead, I wouldn't care.

Also, when you read 50 shades, it's quite obviously based on Twilight because you know it's based on Twilight. If you didn't, you may complain about the similar dynamic, but you'd brush it off as exploitation of a trend, not plagiarism. However, this was not just written with the Twilight characters in mind, it was also published on the internet as Twilight fanfiction.
